Cleveland Co. DA: Use of Force...Justified and Appropriate

The Cleveland County District Attorney will not be filing charges against police officers involved in the altercation with Luis Rodriguez at the Warren Theatre in February. District Attorney Greg Mashburn notified the Moore Police Department of his decision by letter this morning. It brings to a close the criminal investigation into Rodriguez's death.

Nair Rodriguez, the wife of Luis Rodriguez, spoke to reporters after the Moore Police Department press conference on Friday afternoon. Ms. Rodriguez claimed that the Warren Theatre's security video clearly showed the police beating her husband to death. Mashburn noted that the video did show one officer using a legally- appropriate action known as a "knee strike" to help subdue Mr. Rodriguez, whom officers said was aggressive and uncooperative.

Rodriguez became unresponsive after he was handcuffed. He was treated by a paramedical team that was already at the Warren Theatre on another unrelated call. Midwest Regional medical officials say Rodriguez was alive when he was brought into an emergency room, but later died.
